The last line does in fact have the ipv Rule but they also had a responsibility to make you were aware of that rule and to tell you to inspect your device, make sure it was working correctly, and performing to your expectations prior to your leaving the store. Stores with policies like this will usually require the customer to sign an agreement to that effect, usually on the credit card receipt. If they did not do these things you can go to your local consumer protection agency and file a complaint. You will probably win if you do so but they may only have to give you a store credit in exchange.
Personally I would not do any more business with them and would have made that very clear before leaving the store. Very surprised that a local B&M even if it is a franchise would risk losing a customer to mail order by not exchanging a device toward purchase of another mod within days of a purchase. Very bad business model! Very short sighted. People patronize local B&Ms & pay exorbitant prices & they do it simply for the no questions asked, customer is our first priority service.
This guy is acting like you did something wrong & he isn't going to walk into the back room & install new shrink wrap on the package and sell it again to another customer. Who is he kidding? Really bad business!
