At 6PM today (Midwest time), two Duluth City Council members will introduce ordinances (that are sponsored by drug industry funded ACS/AHA/ALA) to redefine smokefree e-cigarettes as "electronic smoking devices", and to ban their use and even possession where smoking is banned.

Bill 13-058 would ban the smoking of any "prohibited" substance wherever smoking is banned, and at additional locations

Bill 13-059 to falsely define smokefree e-cigarettes as “electronic smoking devices”, falsely redefines "smoking" as including the use (and even possession) of an e-cigarette at indoor and many outdoor locations.

According to the confusing and apparently conflicting language of these bills, Duluth already enacted ordinances banning the use and possession of smokeless tobacco products wherever smoking is banned, including at many outdoor locations.

If enacted Ordinances #58, #59 and #60 would ban the use of Electronic cigarettes anywhere smoking is banned (including many outdoor enviroments), Require a city license to sell the product (which doesn't contain tobacco), and even ban electronic cigarette use in stores that exclusively sell electronic cigarettes.
Duluth, just wants to get a little piece of the pie. This is a stretch. If this goes through, its only a matter of time before they figure out how to tax the crap out of it as well.

The meeting will Take place on Thursday September 5th at 5:15pm. The Duluth City Council will hold its critical agenda session.

IamWedge, what I recommend doing.

Go here -- City Council Members

Call AND e-mail the City Council person who represents your district (see the City Precinct maps) and then call AND e-mail all the At Large council members. "At Large" means that the council member represents everyone in the city in Duluth.

Be sure to note that you are from Duluth, as they're likely getting a lot of e-mails from people outside Duluth.

“If enacted, these ordinances, as written, would not only not benefit public health but would have the perverse consequence of actually protecting cigarette markets,” he warned.

At the MN State Fair e-cigarettes were welcomed, while analogs were relegated to smoking areas.

13-058-0 simply states prohibited substances are banned in certain areas, yet doesn't define what they are. Are they defined in the Clean Air Act, or another ordinance, statute or code? The other one would require a license to sell e-cigs. What is the licensing process like? Maybe it is simply filling out a couple of forms and paying $20.

Are there links that weren't posted which provide some more detail?

Make a law because you DONT understand it. Heres the ordinances.

The first ordinance prohibits sampling in establishments that sell the substance which councilors say close a loophole.

The second prohibits people from using e-cigarettes in certain locations such as outside hospitals and places where regular cigarettes are prohibited.

The Third regulates the sale of the cigarettes, stating vendors need a license to sell and people need to be 18 years of age to purchase such devices.

The ordinances will go into effect next month.
