Queensland (QLD). Vapers beware! Banana benders are not that keen in seeing e-cigarettes in their midst. According to the Health (Drugs and Poisons) Regulation of 1996, it states specifically on Part 4 Section 217 that a person cannot legally buy, own or sell a regulated substance that is classified as a Poison. In its Appendix 7b Section 3, nicotine is listed as a regulated poison. As of February 2011, seizures have been enforced.
New South Wales (NSW). South of Queensland is the metropolitan city of Sydney, the capital of New South Wales. At the moment, there are no restrictions imposed on buying or having nicotine containing substances. Selling nicotine is prohibited.
Australian Capital Territory (ACT). Keep your guard up in Canberra. In the ACT Medicines, Poisons and Therapeutic Goods Act of 2008, a provision in Chapter 3 Part 3.1 Section 12 that says nicotine is classified as a Schedule 7 poison.
Victoria (VIC). In smallest state of Australia is another populous city capital, Melbourne. It states in the Drugs, Poisons and Controlled Substances Act of 1981, that there are no current prohibitions for nicotine if it is for personal use. Nicotine use in e-cigarettes is considered as Schedule 2 or Schedule 6.
Tasmania (TAS). The Holiday Isle is another liberal Australian state when it comes to e-cig usage. The Tasmanian Poisons Act of 1971 and the Poisons Regulation of 2008 does not prevent anyone from having nicotine in their possession. Hobart is the largest city of the state but even Macquarie island near the Antarctic also imposes the same laws on nicotine products.
South Australia (SA). Truly the Festival State, you can breathe easy with the Croweaters of Adelaide when it comes to vaping nicotine. It holds the same policy as New South Wales when it comes to the e-cigs. In their South Australian Controlled Substances (Poisons) Regulation of 1991, only retailing or wholesaling nicotine containing products are forbidden.
Northern Territory (NT). Right smack in the northern part of Australia is an ambivalent haven for vapers. You can be in possession of nicotine containing substances if you apply for a permit. Otherwise, the provision on Part 11 of the NT Poisons and Dangerous Drugs Act consider nicotine and all the other Schedule 7 chemicals as hands off.
Western Australia (WA). Another state that allows you to enjoy puffs of nicotine rich vapours surrounds its capital city of Perth. The Western Australian Poisons Act 1964 and the Poisons Regulation of 1965 mention limitations on nicotine. It cannot be sold outright but can be consumed for personal use.
