US Court Denies Rehearing on Graphic Cigarette Warning Labels

Hopefully, Obama's FDA will begin developing warnings that aren't unconstitutional, as another federal court circuit has upheld the constitutionality of the FSPTCA statory requirement for the warnings.
And hopefully, the FDA will more carefully consider the legal ramifications when proposing its forthcoming "deeming" regulation to apply Chapter IX of the FSPTCA to e-cigarettes and other unregulated tobacco products. Ideally, the FDA would just scrap the deeming regulation it has been developing for the past 18 months.
