Another big news day ...

1) CASAA Call on RI: hearing today, 4PM Rm 211 of the St. House at 82 Smith St. - 80% wholesale tax and unreasonable online sales requirements, see: http://blog.casaa.org/2014/01/call-to-action-rhode-island-bill-sets.html

2) A second hearing will be held on WA's SB 6569 tomorrow (Friday) according to post #28: http://www.e-cigarette-forum.com/fo...-cigs-95-referred-senate-ways-means-cmte.html also see: http://blog.casaa.org/2014/02/call-to-action-washington-bill-to.html

3) New study in Nature: Scientific Reports by Dr. Farsalinos concludes that levels of nicotine absorption from vaping 1.8% (18mg/ml) are about 1/4 to 1/3 the level of tobacco cigarettes. This suggests that the EU's TPD limitation of 20mg/ml may be too low to assist some smokers with cessation.

4) Minneapolis MN city council considering extensions of its clean indoor air act to cover vaping, proposal expected to come on 3/7.

5) Cambodia completely bans vaping everywhere for everyone ("to safeguard the health of young people").

6) Massive coverage on the EU Parliament's Approval of the TPD (Tobacco Products Directive), especially Article 18 which deals with vaping. I've only listed the pieces which strike me as particularly noteworthy. I recommend this analysis: http://www.ecita.org.uk/blog/index....of-the-tpd-proposals-on-electronic-cigarettes and this thread on ECF: http://www.e-cigarette-forum.com/fo...urope-has-fallen-big-money-has-triumphed.html or this relatively balanced - by mainstream media standards - review (I haven't broken the link even though it contains junk, as a service to readers of this space who wish to get a general introductin to this newsworthy event of worldwide significance to vapers): http://www.nytimes.com/2014/02/27/b...tronic-cigarettes.html?hpw&rref=business&_r=0

7) Much coverage of the bill introduced yesterday afternoon in the US Congress, which asks the US FTC (Federal Trade Comm'n) to establish guidelines for vaping product advertising in order to "prohibit marketing to children."

8) ANTZ orgs issue press release calling for all retailers to end the sale of "tobacco products" in their stores. Although the PR doesn't seem to contain any explicit references to vaping, previous pronouncements from these orgs seem to suggest that this is their objective. Related: letter from World Lung ...'n to Financial TImes which advocates that UK Pharmacies remove PVs from their shelves (see UK coverage below).

9) Dr. Siegal interviewed on Boston's NPR (public radio) station, does a good job despite both a moderator and a St. Rep guest who each appear to have an excellent grasp of ANTZ propaganda.

10) San Diego CA plans to treat vaping as smoking for all purposes such as B&M licensing and use in public parks, etc. (A ban on selling flavored e-juice may also be in the works). City Atty's office directed to propose ord. w/i 90 days.

11) ALA and other ANTZ org.s push for statewide CA legislation to ban tobacco smoking in multi-unit buildings (and quite likely, vaping - after vaping is automatically included in all anti-smoking legislation).

12) KY's SB 267 is now ready for the Sen. floor (not just a simple minor sales ban - also establishes burdensome reporting requirements).

13) Dallas Morning News comes out against extensions of indoor clean air acts to define vaping as smoking. As far as I know, this is the first time that any major non-partisan US publication has done so, particularly in a major city.

14) BAT, makers of Vype, to release new PV in the UK next year.

Coverage: Cambodia, India, South Africa, UK, Canada, US states: NY, MD, KY, LA, TX, MN, OK, UT, WA, CA

Also: Possible cotine study threat; salacious VIP UK ad; fun piece covers recent ENDD event at the New Museum in NYC; new joint venture in China could dominate domestic market; BAT profits rise.

Title: Nicotine absorption from electronic cigarette use: comparison between first and new-generation devices
(Ind. Pro-vaping web site) http://ecigarette-research.com/web/index.php/research/2014/155-ecig-nicotine
Summary of the original paper, which is available here: http://www.nature.com/srep/2014/140226/srep04133/full/srep04133.html Study provides evidence that vapers absorb approximately 1/4 to 1/3 the amount of nicotine when vaping 1.8% (18mg/ml) e-liquid, as compared to tobacco cigarettes. This suggests that the EU's TPD limit of 2.0% (20mg/ml) is too low to assist some smokers with cessation or perhaps even substantial THR.

Title: E-Cigarettes: Gateway Or Cure? [Features Dr. Siegal]
(Boston MS NPR affiliate) http://radioboston.wbur.org/2014/02/26/e-cigarettes
Although the vaping opponent and the moderator spout junk, I haven't broken the link to this 22-minute radio debate between Dr. Siegal and the chair of the MA house's Public Health cmte. Vapers might consider listening to the entire audio feed for a good example of how to keep calm in the face of outrageous ANTZ claims. Dr. Siegal provides an interesting analogy in response to the one anti-vaping caller who cites the UCR (Prue Talbot) "investigation" - if you're on a sinking ship, you don't worry about whether the lifeboat has been tested, "any smoker who doesn't try to switch to e-cigarettes is making a stupid decision."

Title: FDA Out of Its Mind: Thinks Some Cigarette Brands May Be Safer for the Public's Health Than Others
(Dr. Siegal's Blog) http://tobaccoanalysis.blogspot.com/2014/02/fda-out-of-its-mind-thinks-some.html
Readers of this space will recall that Glantz posted a public comment yesterday about the FDA's interpreation of substantial equivalence, which is what it used to remove the four types of bidis (S. Asian mini-cigars) from the market last week. This was the first time that the FDA had actually taken such action. Vapers worry that this doctrine will be applied to e-juice in the future. This is Siegal's response to the FDA's action and Glantz's public commment.

Title: New Chinese Joint Venture
(ECF's InfoZone) http://www.e-cigarette-forum.com/infozone/news/new-chinese-joint-venture.html
Gary Cox on a new venture in China, which (according to another commentator) may be China's first "mass-marketed e-cigarette."

Title: Open Letter to Pharmacy Chains [ANTZ org.s' Press Release]
(CFTFK web site) http://www.tobaccofreekids.org/content/press_office/2014/openlettertoretailers.pdf
Despite the fact that this press release contains junk, I haven't broken the link as a service to readers of this space. Press release calls on all "retailers, especially those with pharmacies" to end "tobacco sales." It doesn't specifically mention vaping, however previous pronouncements from most of these orgs suggest that this is their goal. Also see letter published in the Financial Times below from the World Lung ...'n which advocates that UK Pharmacies stop selling PVs.

Title: An innovative approach to tobacco harm reduction: sex
(Glantz's blog) http://www.tobacco
.ucsf.edu/innovative-approach-tobacco-harm-reduction-sex

Glantz and the Campaign for Tobacco-Free Kids are outraged that Blu is using titillating ads to sell its products, on the grounds that such advertisements "appeal to youth." Evidently Glantz doesn't believe that either sex or fruit flavors are for adults, who have matured enough to eschew such childish pursuits.

Title: Smokefree movies webinar available for viewing
(Glantz's blog) http://www.tobacco
.ucsf.edu/smokefree-movies-webinar-available-viewing

Having listened to the entirely of Glantz's 30-minute "in depth" interview last weekend on a SF CBS affiliate, your correspondent decided not to expose himself to additional punishment by viewing the webinar. Suffice to say that Dr. Glantz apparently believes that movies such as Casablanca and Citizen Kane deserve "R" ratings, because they depict smoking in a context which isn't explicitly negative.

Title: Association Between Urine Cotinine Levels and Bone Mineral Density in Lumbar Spine and Femoral Neck Among Adult Males
(US NIH website) http://journals.lww
.com/spinejournal/Abstract/2014/02150/Association_Between_Urine_Cotinine_Levels_and_Bone.15.aspx

Although this study only looked at cigarette smokers, it's hard to believe that it won't be used against vapers, since vaping also raises cotine levels.

(So. China Morn. Post) http://www.scmp
.com/news/asia/article/1436440/cambodia-announces-ban-smoking-shisha-and-e-cigarettes

Cambodia completely bans vaping for everyone, including imports and use. National Authority for Combating Drugs says vaping "affects the health more seriously than cigarettes" and "[is] leading young people to take up smoking."

(S. Africa newspaper amalgam site) http://www.iol

Uninformative general piece, some junk. However it does appear that vaping has gotten some attn. in SA, at least in Cape Town. Resyndicated here under a slightly different title: http://allafrica.com/stories/201402270737

(Reuters, UK) http://uk.reuters
.com/article/2014/02/27/uk-britishamericantobacco-results-idUKBREA1Q0CK20140227

Apparently contradicts last week's claim in the Daily Mail to the effect that BAT is losing money on vaping. BAT makes Vype, and has recently launched a large-scale advertising campaign in the UK.

Title: BAT Plans Second E-Cigarette in 2015 to Keep Ahead of Rivals
(US Nat'l business news - re: UK) http://www.bloomberg

New PV slated for UK release, no junk.

Title: United Kingdom: Electronic Cigarettes In The Workplace
(UK employment law and policy web site) http://www.mondaq
.com/x/295806/employee+rights+labour+relations/Electronic+Cigarettes+In+The+Workplace

Junky editorial urges UK regulators to treat vaping as smoking for purposes of indoor clean air regulation. And I do mean indoor: as far as I can tell, there's no place in the UK where smoking is banned outdoors, akin to the American policy of restricting smoking (and now vaping as well as smokeless tobacco) in public parks, on sidewalks, beaches, college campuses, and all other government-owned property. Please PM me if you have better information.

Title: '[:censored]': Are e-cigarette ads going too far?
(UK Nat'l paper) http://www.telegraph
.co.uk/women/womens-health/10663446/Put-it-in-my-mouth-Are-e-cigarette-ads-going-too-far.html

Opinion piece on recent titillating VIP TV ad shown on British TV. Despite the ECF rule banning "sex talk," I've decided to take the risk of covering a story on this advertisement which references a certain erotic practice that happens to be distinct from procreation - since the ad has generated so much interest and coverage in the UK. Youtube video of the ad is embedded in the article.

Title: Pharmacies have been too quick to start selling e-cigarettes
(UK Int'l Business) http://www.ft
.com/intl/cms/s/0/262e9e52-9d88-11e3-a599-00144feab7de.html#axzz2uWc1vZ3b

Letter from the Chief Scientific Officer of the World Lung Foundation to Financial Times contains some junk, as expected. Noteworthy because of the writer, and the recent press release issued here in the states by CFTFK and related orgs - see above.

Similar to Sullum's recent pro-vaping analysis of last Sunday's NYT article in Forbes, which was lauded by Gary Cox on ECF's InfoZone.

Title: Raising Questions (letter to the ed.)
(Vernon BC Ca local paper) http://www.vernonmorningstar
.com/opinion/letters/247081931.html

Another example of a nice pro-vaping letter to the editor, Canadian-style (i.e.: written for readers with longer attention spans and higher literacy levels than those which appear to prevail here in the states.

Title: U.S. Senators Look for E-Cigarette Marketing Limits

Title: Editorial: The e-cigarette problem [opposes indoor vaping bans]
(Dallas TX US local paper) http://www.dallasnews
.com/opinion/editorials/20140226-editorial-the-e-cigarette-problem.ece

While this editorial contains alarmist junk about minors (i.e. the assertion that 0% nic. flavored PVs are "obviously designed as a gateway to the adult world of smoking"), it comes out against the idea that indoor clean air acts should be extended to define vaping as smoking. This is by far the largest and most influential US city newspaper to take such a stand, so far as I know. I'm not aware of any vaping legislation currently proposed in the TX legislature. Please PM me if you know differently.

Title: Minnesota Legislators try to clear confusion over e-cigarettes
(Twin Cities MN US local paper) http://www.startribune
.com/politics/statelocal/247405381.html

Report on hearing yesterday in the MN house about two bills that would extent MN's indoor clean air act to ban both indoor vaping as well as outdoor vaping in parks, etc. Despite the title, the piece is remarkably balanced (which means it contains junk from vaping opponents, of course.) "Chairwoman Tina Liebling, DFL-Rochester, twice admonished the crowd that no vaping was allowed in the room, insisting that she could smell it. No one was spotted using a vaping device." Some inquiring minds might wonder how the good Chairwoman might describe the "smell" of vaping.
[ MN wants to extend its indoor clean air act to define vaping as smoking. Covers outdoor vaping too, see: http://blog.casaa.org/2014/02/call-to-action-minnesota-e-cigarette.html ]

Title: E-Cigs Could be Added to Minnesota Indoor Clean Air Act [reports on Minneapolis too]
http://kstp.com/news/stories/S3341251
.shtml

This story is particularly noteworthy because of the last paragraph: "The Minneapolis Health Department declined to speak on this issue until March 7, which is when the city council will likely adopt some policy around this specifically, whether to support this change in their legislative agenda.". Some junk.

Title: Minn. bills would treat e-cigs as standard smokes

(Minot ND US local paper) www.minotdailynews.com/page/content.detail/id/592629/E-cigarette-worries.html?nav=5010
This could've been an unadorned straight factual report on the passage of a simple minor sales ban, but apparently the writer saw fit to augment it with alarmist minor "gateway" junk. Remarkably, the piece contains no junk regarding adult use. ND defines vaping as smoking for purposes of statewide clean air laws, and is currently considering a simple minor sales ban.

Title: Gavel to Gavel: E-cig regulations will develop
(OK US employment law web site) http://journalrecord
.com/2014/02/26/gavel-to-gavel-e-cig-regulations-will-develop-opinion/

Largely junk-free but clearly anti-vaping piece in which a "shareholder" (not identified as an atty) advises that: "Businesses interested in controlling e-cigarette usage in and around their facilities should consider creating a new policy or modifying their current tobacco use policy to specifically address e-cigarettes. The policy could, if desired, set the same standards for e-cigarette usage as are currently in place for other tobacco products. Until regulators and legislatures determine how these products are classified and supervised, businesses would be wise to treat e-cigarettes as distinct and separate from traditional cigarettes. (Boldface added.)" It's rather unclear what this apparently contradictory advice is intended to convey.
[ SB 1892 is a mixed bag for proponents of smoke-free alternatives, because it raises the tax on Snus and other smokeless products, but exempts vaping. See: http://www.e-cigarette-forum.com/fo...g-bills-introduced-oklahoma-hearing-held.html

Clearly, the intent is to treat vaping as smoking for all purposes, including regulations on sales (B&M licensing) as well as outdoor vaping on municipal property such as public parks or sidewalks. There are some hints in the article that SD may also be looking to ban the sale of flavored e-juice. Some junk, other stories collected at end of this post.

Tip: to see whether there are bad things happening where you live, try this Google search (example for Rhode Island) -
rhode site:casaa.org
(Replace rhode with a single word that describes your city, county, or state. For ex., if you live in Eau Claire, WI - you might use "Claire" to see if something is being proposed at the city level. Don't forget the : (colon), and be sure that there's nothing before or after the colon (not even spaces or tabs.)

You can also try replacing site:casaa.org with e-cigarette to find out what the media is reporting in your area. This is usually most helpful if you use the search tools to search by date. (CASAA doesn't generally issue calls or alerts until a bill is out of a state legislative committee, or is scheduled for a local city or county hearing.)

FYI, my home-town paper may be technically non-partisan, but still very conservative/right-wing (not that there's anything wrong with it, but there you are). :)

My theory is that when just about everyone views themselves as "conservative," then you see a cleavage between conservatives who believe that the gov't has an important role to play in regulating personal morality, and those who tend to be a bit more Libertarian.

This may explain why there are plenty of dark-red jurisdictions (and perhaps news rooms) in which there are a majority of people who feel that smoking (and by extension, vaping) is disgusting, and deseves to be stamped out. Perhaps this is out of concern for children, or maybe they're offended by some of our younger fellow (adult) vapers. I also rather suspect that many of these folks may have strong religious convictions that influence their view of government policy.

At the same time, you have very conservative groups of people in which a majority lean Libertarian, and so yoiu'll see the opposite result.

Sometimes the first type of "conservative" is also influenced by a reflexive desire to take a position which they view as antithetical to that taken by national Democrats, or Dems in their own jurisdiction. This may help to explain this year's result in Ohio. It may also help to explain why some national conservative news media outlets take such a strong pro-vaping stand.

If national Democrats were as fond of vaping as they are of (say) needle exchanges for intravenous drung addicts, perhaps we'd see some of these national conservative media outlets and maybe some GOP politicians adopt a different POV. (And do national Dems react with the same strength of instinctive loathing towards smoking and BT, as some of these Repubs do to those very Dems? Hard to say.)

Part of me has to wonder whether the science actually matters to any of these folks. Seems to me that most if not all of them (whether pro- or anti-vaping) are just "painting by the ideological numbers," as it were - trapped in some kind of pre-cognitive tribal reflexive "groupthink." Their amygdalas and perhaps their medula oblangatas are doing what their cerebral cortex ought to be doing.

It's like watching one of those nature shows in which one group of chimpanzees attack another. They don't really know "why" they're doing it, or even what larger goals they're attempting to bring to fruition. They're just fighting the chimps in the other group because the chimps in their group are doing likewise.
